Terms of Use Oahu Mobile Car Detailing
Effective Date: August 15, 2025
1. Definitions
For purposes of these Terms of Use (“Terms”):
- “Company,” “we,” “our,” “us” — Oahu Mobile Car Detailing, a Hawaii-based mobile car detailing business. License #: GE-154-161-7152-01.
- “Customer,” “you,” “your” — any individual or entity booking or receiving Services.
- “Services” — mobile auto detailing, washing, polishing, interior cleaning, ceramic coating, paint correction, and related work performed by the Company.
- “Vehicle” — any automobile owned, leased, rented, or lawfully controlled by the Customer.
- “Booking” — a confirmed appointment scheduled via our website, phone, email, or other official channel.
- “Site” — this website located at https://oahumobilecardetailing.com
2. Acceptance of Terms
By accessing the Site, booking Services, or otherwise engaging with the Company, you acknowledge and agree to be bound by these Terms. If you do not agree, you must not use the Site or Services.
3. Eligibility
- You are at least 18 years old (or have legal authority of a parent/guardian).
- You have lawful authority over the Vehicle presented for Services.
- You provide accurate and truthful information during Booking.
We may refuse Service if eligibility requirements are not met.
4. Services Provided
We provide mobile detailing Services at the Customer-designated location using professional-grade equipment and eco-friendly products. We may modify, suspend, or discontinue Services at our discretion.
5. Customer Responsibilities
- Provide a safe, lawful, and accessible environment for Services, including legal parking and necessary access to the Vehicle (keys/fobs as needed).
- Remove valuables and personal items prior to Service. We are not responsible for items left inside the Vehicle.
- Disclose pre-existing conditions or sensitive surfaces (wraps, vinyl/PPF, tint, aftermarket electronics, custom paint).
- Maintain appropriate insurance coverage for your Vehicle.
6. Bookings
- Bookings are subject to availability and confirmed only upon Company approval.
- Arrival times are estimates; delays may occur from traffic or unforeseen circumstances.
- We may reschedule due to weather, safety, or operational needs.
7. Payments
- Payment is due upon completion of Services unless otherwise agreed in writing.
- We accept cash, major credit/debit cards, and approved electronic methods; we may place a pre-authorization hold for estimated charges.
- Additional fees may apply for oversized vehicles, excessive dirt, heavy pet hair, biohazards, or misrepresentation of Vehicle condition.
8. Cancellations and No-Shows
- Cancellations made more than 24 hours in advance incur no fee.
- Cancellations within 24 hours may incur a fee up to 50% of the quoted service price.
- No-shows or denied access at arrival may be charged up to the full quoted price.
- If we are responsible for a significant delay without notice, you may cancel without fee.
9. Service Limitations and Risks
Cleaning/restoration outcomes vary by age, wear, materials, prior repair/chemicals, oxidation, and staining. We do not guarantee complete removal of odors, stains, smoke residue, water spots, pet hair, etching/oxidation, or permanent headlight clarity. We may decline high-risk tasks (e.g., severely oxidized clear coat, unstable headliners, leaking sunroof drains, non-OEM electronics).
10. Special-Risk Items (Owner Responsibility)
- Engine bay: Electronics, sensors, alternators/coils, degraded wiring or brittle plastics can fail during/after cleaning due to pre-existing condition, trapped moisture, or vibration. Owner assumes risk for latent defects.
- Aftermarket electronics & accessories: Owner is responsible for stability/fitment (alarms, radios, dash cams, light bars, etc.). We are not responsible for electronics & accessories.
- Wraps/PPF/tint/convertible tops: Delicate films/soft tops can lift, haze, or damage when contaminated, aged, or poorly applied. Services are at owner’s risk.
- Child car seats: On request we can clean seats/bases; re-installation and fit checks are the caregiver’s responsibility per manufacturer guidance. We do not certify installation.
11. Claims Procedure
- Submit any claim in writing with photos to info@oahumobilecardetailing.com within 48 hours of Service completion and before any third-party repairs.
- You agree to make the Vehicle available for our inspection; we may request additional information/estimates.
- Exclusions include: pre-existing damage; latent/material defects; normal wear/tear; ill-fitted/aftermarket accessories; prior chemical damage; items left in the Vehicle.
- Failure to submit a timely claim waives your right to dispute charges.
12. Disclaimer of Warranties
ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE AT ISSUE. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS OR DATA), EVEN IF ADVISED OF THE POSSIBILITY.
Some jurisdictions do not allow certain limitations; in such cases, the limitations apply to the maximum extent permitted.
14. Indemnification
You agree to defend, indemnify, and hold harmless the Company, its employees, contractors, and affiliates from and against claims, damages, losses, liabilities, and expenses arising out of or related to your use of the Services, your violation of these Terms, or your negligence/misconduct.
15. Force Majeure
We shall not be liable for delays or failures to perform due to causes beyond our reasonable control, including severe weather, natural disasters, government actions, labor disputes, power/internet outages, supply issues, or other emergencies.
16. Photos & Marketing
We may document work with before/after photos. We avoid personal information/plates; you may opt out of marketing use by notifying us in writing. Operational documentation may still be retained.
17. Intellectual Property
All Site content (text, logos, graphics, images) is the exclusive property of Oahu Mobile Car Detailing and protected by IP laws. You may not copy, distribute, or exploit Site content without written consent.
18. Termination; Right to Refuse
We may refuse or terminate Services at any time if conditions are unsafe, unsanitary, unlawful, or violate these Terms.
19. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Hawaii, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Honolulu, Hawaii, and waive any right to jury trial to the extent permitted by law. Small-claims court claims are permitted.
20. Updates to These Terms
We may update these Terms from time to time. The Effective Date above reflects the latest version. Material changes to pricing or cancellation policies will be communicated in a manner you can retain (e.g., email). Continued use after the effective date means you accept the changes.
21. Miscellaneous
- Entire Agreement: These Terms (plus any service-specific terms shown at booking) are the entire agreement between you and the Company regarding the Services.
- Severability: If any provision is unenforceable, the rest remains in effect.
- Assignment: You may not assign your rights; we may assign to an affiliate or in a merger/sale.
- No Waiver: Failure to enforce is not a waiver.
- Headings: Section titles are for convenience only.
